Q. 1. Who is eligible for a Business Visa?
Ans.: A Business visa may be granted to a Chinese/foreign national for the following purposes:-
i. Chinese/Foreign Nationals who wish to visit to establish an industrial/business venture or to explore possibilities to set up industrial/business venture in India.
ii. Chinese/Foreign nationals coming to purchase/sell industrial products or commercial products or consumer durables.
iii. Chinese/Foreign Nationals visiting India for technical meetings/discussions, attending Board meetings, general meetings for providing business services support.
iv. Chinese/Foreign Nationals visiting India for recruitment of manpower.
v. Chinese/Foreign Nationals who are partners in the Business and/or functioning as Directors of the company.
vi. Chinese/Foreign Nationals coming to for consultations regarding exhibitions or for participation in exhibitions, trade fairs, business fairs, etc.
vii. Chinese/Foreign buyers who come to transact business with suppliers/ potential suppliers at locations in India, to evaluate or monitor quality, give specifications, place orders, negotiate further supplies etc., relating to goods or services procured from India.
viii. Chinese /Foreign experts & specialists on a visit of short duration in connection with an ongoing project with the objective of monitoring the progress of the work, conducting meetings with Indian customers and/or to provide some high level technical guidance.
ix. Chinese/Foreign Nationals visiting India for pre-sales or post-sales activity not amounting to actual execution of any contract or project.
x. Chinese/Foreign Trainees of multinational companies/corporate houses coming for in-house training in the regional hubs of the concerned company located in.
xi. Chinese /Foreign students sponsored by Association Internationale des Étudiants en Sciences Économiques et Commerciales (AIESEC) for internship on project based work in companies/industries.
xii. Chinese/Foreign nationals visiting India as tour conductors and travel agents and /or conducting business tours of foreigners or business relating to it, etc.
Q. 2. What is the duration of a Business Visa?
Ans.: As per the Memorandum of Understanding (MoU) on Simplification of Visa procedures signed between the Republic of India and the People’s Republic of China in June 2003, the following categories of Business visas (applicable for PRC nationals) are issued:
i. Six months Multiple Entry Business Visa may be issued on the basis of a letter of invitation from a “Recognized Indian Organization” apart from other documents specified in the checklist.
ii. 2 months Single Entry Business Visa may be issued on production of a letter of request from a “registered Chinese company / organization” apart from other documents specified in the checklist.
Q. 3. What are the documents to be submitted along with application for a Business Visa?
Ans.: Following are the documents that need to be submitted for a Business Visa:
• Original / Fax copy of Invitation letter from a recognized Indian company / organization.
• Certificate of Incorporation / Business Registration Certificate of Indian company
• Dispatch letter from the company of applicant (Details should include the purpose of visit, annual income of the applicant and undertaking of the financial guarantee)
• Business License / Registration Certificate of Chinese Company authenticated in English.
• CCPIT registration / certificate of incorporation of the Chinese company.
Q. 4. Whether Business visa can be converted to any other type of visa within the country?
Ans.: Business visa cannot be converted to any other kind of visa during his/her stay in India except in the following circumstances and with the prior approval of the Ministry of Home Affairs:
a). Business visa can be converted to ‘X’(Entry) Visa if a Chinese/foreign national who has come to India on Business visa marries an Indian national during the validity of his/her visa and does not intend to continue on Business Visa. Such conversion would be considered subject to fulfillment of following conditions:
o Submission of a copy of registered Marriage Certificate , and
o Report from the Foreigner’s Regional Registration Office (FRRO) / Foreigners Registration Office (FRO) concerned about their marital status which will inter-alia include his/her antecedents, confirmation about their living together and security clearance
b). Business visa of the Chinese / foreign national who falls ill after his / her entry into India rendering him / her unfit to travel and requires specialized medical treatment may be converted to Medical visa if he / she is eligible for grant of Medical Visa and medical certificate is obtained from government / government-recognized hospitals. In such a case, ‘X’ visa of family members/ attendant accompanying the foreigner (whose ‘Business’ visa is converted into Medical Visa) may also be converted into Medical Attendant [Med X] visa co-terminus with the Medical visa of the foreigner.
Note: On conversion of Business visa into ‘X’ visa / Medical visa/ ‘Med X’ visa, the following endorsement shall be made on the Passport / Residential Permit - “Employment/Business not permitted”.
Q. 5. Which category of Visa will be granted to family members of foreign nationals coming to India on Business Visa?
Ans.: Family members / dependents of a foreigner who is granted ‘Business Visa’ may be granted ‘X’ visa subject to usual security checks provided the family members are otherwise eligible for grant of such a visa . Its validity should be co-terminus with the validity of the visa of the principal visa holder or for such shorter period as may be considered necessary by the Indian Mission.”
Q. 6. Can foreign nationals coming to execute projects in India be granted Business Visas?
Ans.: No. A foreign national coming for executing projects / contracts will have to come on Employment / Project Visa.
Q. 7. Can foreign nationals already in India for executing projects on Business Visas be allowed to extend their Business Visas?
Q. 8. Can foreign nationals already in India for executing projects on Business Visas be allowed to convert their Business Visas to Employment Visas without leaving the country?
Q. 9. Whether a Chinese/foreign national visiting India on a Business Visa is required to be registered with Foreigner’s Regional Registration Officer (FRRO)?
Ans.: Generally foreign nationals visiting India on visa that is valid for more than 180 days must register with the concerned FRRO / local police within 14 days of their first arrival at the place of their residence, irrespective of the actual duration of stay in India. Children below 16 years of age do not require registration.
Q. 10. Where can a foreigner register himself?
Ans.: A foreigner must register with the FRRO (in case of Delhi, Mumbai, Kolkata, Amritsar, Bengaluru, Chennai and Hyderabad); or with FRRO cum District Superintendents of Police (SP) at other places where the foreigner intends to stay.
